Terms and Conditions of Use and Privacy Policy
The use of this site (henceforth www.jmv.pt ), the responsibility of the JMV – José Maria Vieira, S.A, whose headquarters are situated in Rua D. Henrique 421, 4436-909 Rio Tinto (henceforth designated as JMV), is subject to the Terms and Conditions and the Privacy Policy currently in force.
1. Use of the site
By browsing www.jmv.pt, the user acknowledges that they have read and understood the Terms and Conditions of Use and Privacy Policy, as detailed below.
The site provides information on JMV - José Maria Vieira, SA and the products marketed by this company. Users should end their visit and leave the site if: (i) they do agree with or accept the Terms and Conditions of Use or Privacy Policy for the site; (ii) they are not of a legal age to consume alcoholic beverages in the country in which they are in.
While visiting the site, users undertake not to engage in any acts that might harm or damage JMV’s image, interests or rights, or those of any third parties, or harm, damage or overload the site or make it unusable or prevent, in any way, the normal use of the site.
2. Privacy
The site has been designed in such a way as to ensure that the user's privacy is fully respected and that their personal information is duly protected in accordance with Law no. 67/98, dated 26 October (“Personal Data Protection Law”).
This Privacy Policy can be freely accessed at www.jmv.pt.
The term “personal information”, as used in this policy, refers to any information, of any type and irrespective of how it is stored, that pertains to an identified or identifiable natural person, as established in the Personal Data Protection Law. JMV will not process your personal information without your consent, where this is not permitted by law. JMV undertakes to comply fully with the Personal Data Protection Law and any other current EU law that pertains to the processing of personal information.
Personal information that has been collected may flow around the network in an insecure manner and may be accessed and/or used by third parties that have not been authorised to do so, despite the fact that appropriate security measures have been put in place to safeguard against accidental or unauthorised destruction, accidental loss and the unauthorised access, modification or dissemination of this personal information.
JMV will not pass on any of the user’s personal information to third parties without proper authorisation from the user, except when authorities charged with enforcing the law or court rulings request JMV’s collaboration in identifying the user.
JMV may use the data that the user provides to the site to furnish additional information that is deemed to be of interest to the user, provided that the user has given their consent to the processing of their personal information. Pursuant to Decree-Law no. 7/2004, dated 7 January, the user will always be afforded the right to oppose this sending of additional information, by emailing JMV at jmv@jmv.pt.
The user of this site may, at any time, exercise all and any of the rights enshrined in articles 10, 11 and 12 of the Personal Data Protection Law, including the right to access, correct, cancel or oppose said personal information. JMV aims to ensure that personal information is up-to-date, accurate and complete. If you wish to access, correct, cancel or oppose the processing of your personal information, please send us a written request, either by post to the address stipulated in the first paragraph of these General Terms and Conditions or by email to jmv@jmv.pt.
3. Cookies - Storage of user information
Pursuant to Law no. 41/2004, dated 18 August, JMV will only store information or access stored information on the user’s device (through the use of cookies) if the user has given their prior consent to this. The site employs cookies to improve the browsing experience. The web server will only log and store that information that is, by definition, usually logged by a server: the internet protocol address that the user used to access the internet; the date the user accessed www.jmv.pt and the duration of their visit and the internet address of the site from which the user directly accessed www.jmv.pt.
The information that is logged is used to measure the number of visits to the various pages that comprise the site, which, in turn, allows JMV to make the site more useful to its users. JMV does not use such information to track or compile any of the visitor’s identity-related personal information. This includes not linking the IP address to the identity of the computer user.
4. Intellectual Property
No Intellectual or Industrial Property rights pertaining to www.jmv.pt, or to any component part of the site, shall be ceded by means of these General Terms and Conditions (or through access to www.jmv.pt or through the use of any of the site’s contents or services). The user is expressly forbidden to reproduce, transform, distribute, disseminate, make available, extract, reuse, resend or use any part of the site, for any purposes or by any means or methods, except where so permitted by law or when written authorisation has been given by the corresponding rights holder.
JMV understands that all the information that the user may provide to the site, namely, but not only, suggestions, ideas and concepts, becomes its property and is for its sole use, to the extent permitted by the applicable legislation. Thus, the user accepts that JMV may make use of any information that the user has input into the site and that JMV is not obliged to inform, compensate or acknowledge the user in this regard.
5. Links to other sites
JMV includes links to the websites of other entities on its site. These links are provided to facilitate the user’s access to information that we believe may be of interest to them. JMV is not responsible for any of these other websites or for their contents and the Terms and Conditions of Use and Privacy Policy set out here do not apply to any of these sites.
6. Limited Liability
To the extent permitted by the applicable legislation, JMV may not be held liable by the user of the site for any damage, decision or inaccuracy, including but not limited to, direct, indirect or incidental damage that may result from the user’s correct or incorrect use of the site or of its contents.
7. Miscellaneous Provisions
JMV may alter these Terms and Conditions of Use or Privacy Policy at any time and do so without prior notice. Therefore, users of the site are advised to revisit this section on a regular basis.
